A proposed advisory opinion on AI tools for Florida lawyers doesn't have a draft yet. Mailed comments must be postmarked by Dec. 1, and the committee meets Dec. 10, so firms can start the inventory now.
MIAMI - Floridant -- MIAMI, Oct. 26, 2026 — The Florida Bar said Oct. 15 that its Board Review Committee on Professional Ethics will consider adopting a proposed advisory opinion on Thursday, Dec. 10, from 1 to 3 p.m., at the Board of Governors' direction. According to the notice, there are no drafts for the committee's consideration at this time, and the Bar is asking members for comments. Those can be emailed or mailed, though mailed comments must be postmarked no later than Dec. 1. The notice linked at the end has both addresses.
The notice lists four subjects the opinion may consider. Give each one its own page and fill it from the tools people actually used this month. These pages are an office inventory, and firms should consult counsel before a comment goes out or a policy changes.

Agentic tools belong on the first page. List every AI tool that can carry a task forward on its own, including one that sits inside software the firm already licenses.
The notice also covers tools that record, transcribe or summarize communications. For those, write down whether anyone is told the tool is running, and keep the exact words the firm uses today. Nothing in the notice sets a script or says a warning must be given.
When it comes to clients, record the guidance the firm already gives them about their own AI tools. The notice raises that subject but doesn't supply any wording.
Florida Ethics Opinion 24-1 is the last of the four, and the notice says an update to it may be considered. Pull the policies and templates the firm would open if that guidance changed.
Apart from those four subjects, the notice also invites suggestions on fee arrangements the opinion should address.
